Summons and Complaint – September 2023
Progress Report:
A fresh Summons and Complaint have now been personally served on the Defendant Regents of the University of California (UC) in the new tort action of People’s Park Council, et al. vs. Regents of the University of California, Case No. 23CV040539. (The process serving fee was $75.00.) The Proof of Service is attached.
Incidentally, I had independently noticed, as had the process server, that the Case Number for the Summons is from a different from that of the Complaint and other papers in the new filing. The Court Clerk inadvertently used the Case Number [RG21105966] from previously-existing case, Make UC a Good Neighbor v. UC, a case that was amended about the same time, instead of the new Case Number [23CV040539].
I duly reported that discrepancy to my e-Filer. I will also report this issue to the Court Clerk, whose error it was. In fact, the Court Clerk seems to have filed the new Summons (but not Complaint) in the old case file. I went ahead and arranged to serve the papers just as received electronically from the Court Clerk. I concluded that I could and should not alter the Clerk’s mistake as to the Case Number. Of course, I will enter the correct Case Number on all our future filings.
